OVERVIEW

According to a recent study, people favour mediation and negotiation to settle disputes instead of litigation because of how the processes work. In mediation for example, parties rely on help of a neutral “mediator” to facilitate constructive communication leading to voluntary agreement by both parties. Decision making rests with the parties themselves. An outstanding benefit of mediation is that, parties get empowered by learning how to improve their conflict resolution and communication skills making it possible for parties to solve problems on their own whenever dispute arises.

In most developed countries, mediation and negotiation as parts of Alternative Dispute Resolution (ADR) has been used to resolve a wide range of disputes without going to court. They offer an alternative to destructive confrontation, prolonged litigation and violence both at home and in the workplace. Mediation and negotiation skills, no doubt, make conflict resolution faster and cheaper within families, communities, schools, workplace and even commercial and public disputes.
